Vitium Reale Law and Legal Definition
The term vitium reale means an inherent taint or defect in a title to property. The term is also known as labes realis. The effect of vitium reale is that the instrument on which it is found is null. And the person who acquires such an instrument will not acquire any right from the instrument. For example forgery import a vitium reale. The reason is that no one transfer to another a right which s/he does not possess. Defect in a heritable property will follow the successor also. Bonafide intention will not remedy the defect in title.
