Weeds Law and Legal Definition
Some states and local governments have laws and ordinances regulating weeds on sidewalks and private property. Laws vary by state and locality, but in some cases, weeds may be declared a public nuisance for constituting a fire or safety hazard. Also, some areas attempt to enforce community standards by imposing fines on properties overrun with weeds due to concerns of eyesore conditions and lowering neighborhood property values. However, such ordinances are subject to constitutional limitations involving a person's right to enjoyment of their property.
Some laws and regulations may be enforced by fines, or by assessments for costs of weed removal. Generally, notice of the nuisance condition is required to be given prior to any enforcement actions.
