Well Permit Law and Legal Definition
Water well permits are governed by state and local laws, which vary by jurisdiction. The process of obtaining a water well permit involves primarily identifying potential sources of contamination and then maintaining separation distances to protect the water quality. Well permits are required to assure construction consistent with regulations for the safeguarding of persons and property from hazards arising from unsanitary and unhealthy drinking water and to assure an adequate supply of water.
Water well permits are required prior to commencing construction. Well permits may be required for commercial, industrial, municipal, irrigation, feed lot, geothermal, recovery wells, and other uses. In some cases, permits are not required for test holes, temporarily dewatering wells with a short-term use, or water wells designed and constructed to pump (yield) under a certain number of gallons per minute. The permit process may require site inspection and water quality testing. Local laws should be consulted for specific requirements in your area.
