Word Mark Law and Legal Definition
Word mark is a standardized graphic representation of the name of a company, institution, or product name used for purposes of identification and branding. In such a type of trademark, the trademark owner is only claims rights in the word, letters, numbers, or slogans without claiming any right in the way those words are presented. When expressed as a word mark an organization’s name is incorporated as a simple graphic treatment to create a clear, visually memorable identity. The representation of the word becomes a visual symbol of the organization or product. There will be no design or logo associated with the mark. Therefore, trademark protection of a word mark provides broader protection than a trademarked logo incorporating those words, because all appearances and use of the words are protected. In the U.S., word mark can be registered, making it protected intellectual property. In the U.S., the term word mark will not only refer to the graphical representation, but the text itself may be a type of trademark.
