Writ of Recaption Law and Legal Definition
A writ of recaption is a writ to recover goods and damages for a person whose goods, being seized for rent or other services are seized again for the same cause. Such a writ allows a plaintiff to recover goods and damages from a defendant who makes a second distress while a replevin action for a prior distress is pending.
This writ allows a person to recovers the goods and damages for the defendant’s contempt of the process of the law in making a second distress while the matter is pending before the court.
