Government Owned Invention [Patents] Law and Legal Definition
According to 37 CFR 404.3 (a) [Title 37 -- Patents, Trademarks, and Copyrights; Chapter IV -- Assistant Secretary for Technology Policy, Department of Commerce; Part 404 -- Licensing of Government Owned Inventions], the term Government owned invention means “an invention, whether or not covered by a patent or patent application, or discovery which is or may be patentable or otherwise protectable under Title 35, the Plant Variety Protection Act (7 U.S.C. 2321 et seq.) or foreign patent law, owned in whole or in part by the United States Government.”
