Guardian in Socage Law and Legal Definition
Guardian in socage is a person who has custody over the lands of a child and the person also. The lands are passed to the child by way of descent. The guardian will have right over the property and person of the infant until the child reaches the age of fourteen. Generally, such guardians are next of kin of the child who has no inheritance over the child’s property. Guardians in socage will be present only if a general guardian is not appointed. The rights and authority of every such guardian shall be superseded by a testamentary or other guardian appointed.
