Health Information Law and Legal Definition
Health Information is defined as any information about the past, present or future physical or mental health or condition of an individual, provision of health care to an individual or payment for health care to an individual, that is created or received by a health care provider, health plan, public health authority, employer, life insurer, school or university, or health care clearinghouse. Health information can be in any form such as oral or written and in any medium. Generally, health information gives details about genetic conditions and the genes responsible for those conditions, descriptions of the symptoms, diagnostic process, treatment options and provides public information about clinical trials and opportunities to participate in the evaluation of new treatments and drugs.
The term "health information" is defined under 42 USCS § 1320d (4), as any information, whether oral or recorded in any form or medium, that :
(A) is created or received by a health care provider, health plan, public health authority, employer, life insurer, school or university, or health care clearinghouse; and
(B) relates to the past, present, or future physical or mental health or condition of an individual, the provision of health care to an individual, or the past, present, or future payment for the provision of health care to an individual.
