A hotel divorce is a form of collusive divorce. A hotel divorce is a kind of divorce where the parties try to show that adultery has occurred, in order to get divorce. A hotel divorce occurs before widespread passage of no-fault divorce laws in which the spouses agree to fake an adultery scene to create “fault.” Obviously, a lawyer will not participate in such a scheme to make it appear to the court that a ground for divorce has occurred when this is not the reality. Hotel divorces are prevalent in jurisdictions where adultery is the only ground for divorce.
