Housing Discrimination Law and Legal Definition
Housing discrimination is discrimination of protected class in the purchase or rental of housing, on the basis of race, gender, ethnicity, age, national origin, sexual orientation and gender identity, marital status, or veteran status. Housing discrimination can be classified into rental discrimination, sales discrimination, lending and mortgage discrimination and homeowners insurance. In order to make a prima facie case of housing discrimination a plaintiff must show: (1) that s/he is a member of a protected class; (2) that s/he applied for and was qualified to rent or purchase certain property or housing; (3) that s/he was rejected; and (4) that housing or rental property remained available thereafter. However, an individual cannot be said to have aided or abetted housing discrimination merely by purchasing real property which is the subject of a complaint before the Human Rights Commission, even if s/he knows of the existence of such complaint. In U.S., housing discrimination was prohibited by the Civil Rights Act of 1968.
