IFP Affidavit Law and Legal Definition
IFP affidavit is an affidavit made by an indigent person. The affidavit seeks for public assistance, appointment of counsel, and waiver of court fees or other public services fees. An IFP affidavit is also termed poverty affidavit, in forma pauperis affidavit, or pauper’s affidavit.
A poverty affidavit must state that the defendant is unable by reason of poverty to pay the costs of the appeal. [State v. Weyerman, 3 NCA 563 (Neb. Ct. App. 1993)].
