Immaterial Variance Law and Legal Definition
Variance is a discrepancy or disagreement between two instruments or two allegations in the same cause, which ought by law to be entirely consonant. Immaterial variance is that discrepancy between the pleading and proof of a character which is so slight, that the adverse party cannot say that s/he was misled thereby.
