Improper Use of Process Law and Legal Definition
An improper use of process may be shown by:
a. filing a complaint without probable cause; or
b. an irregularity or impropriety suggesting extortion, delay, or harassment, or other conduct formerly actionable under the tort of abuse of process. [Durham v. Guest, 145 N.M. 694 (N.M. 2009)].
