Improvement Patent Law and Legal Definition
Improvement patent refers to a patent which has claims directed to an improvement on a preexisting invention. The owner of the improvement patent should have a license to practice the invention which is covered by the claims of the improvement patent, if the preexisting invention is patented by another. Similarly, the preexisting invention's patent owner should possess a license to practice the invention in the improvement patent.
