Incapacitated Law and Legal Definition
Pursuant to Uniform Custodial Trust Act, “Incapacitated" means lacking the ability to manage property and business affairs effectively because of mental illness, mental deficiency, or physical illness or disability. The reasons may also include chronic use of drugs, chronic intoxication, confinement, detention by a foreign power, disappearance, minority, or other disabling cause.
