Indian Divorce Law and Legal Definition
Indian divorce is a divorce between a husband and wife living in Indian Territory. An Indian divorce should be in accordance with established custom among the Indian tribe, effected completely by separation by mutual consent.
Indian divorce, recognized by the tribe as valid under its customs and usages, will be recognized and treated as valid by the state courts. [Cyr v. Walker, 29 Okla. 281 (Okla. 1911)].
