Indian Title Law and Legal Definition
Aboriginal title is referred to as Indian title in the United States. It is the right of occupancy granted by the federal government to an American Indian tribe based on the tribe’s immemorial possession of the area. The test for the acknowledgement of title is actual, exclusive and continuous use and occupancy for a long time, which can be 30 years. Unlike all common law jurisdictions, the United States acknowledges that aboriginal title may be acquired post-sovereignty.
