Indictable nuisance is a common law offense against the public peace, the public health, or the public morals. [State v. Waymire, 52 Ore. 281 (Or. 1908)]
For instance, the pollution of water, or the maintenance of dams, drains, or ditches, in such a way as to emit disagreeable or unwholesome odors, is not only an actionable, but an indictable nuisance. [Exley v. Southern Cotton Oil Co., 151 F. 101, 103 (C.C.D. Ga. 1907)]
