According to 46 CFR 4.03-1(Title 46 – Shipping; Chapter I - Coast Guard, Department Of Homeland Security; Subchapter A - Procedures Applicable To The Public; Part 4 - Marine Casualties And Investigations; Subpart 4.03 – Definitions), The term individual directly involved in a serious marine incident “is an individual whose order, action or failure to act is determined to be, or cannot be ruled out as, a causative factor in the events leading to or causing a serious marine incident.” (46 CFR 4.03-4)
