Infection with the Human Immunodeficiency Virus (HIV) Law and Legal Definition
According to 38 CFR 1.460 (Title 38 -Pensions, Bonuses, And Veterans' Relief; Chapter I - Department Of Veterans Affairs; Part 1 - General Provisions; Release Of Information From Department Of Veterans Affairs Records Relating To Drug Abuse, Alcoholism Or Alcohol Abuse, Infection With The Human Immunodeficiency Virus (HIV), Or Sickle Cell Anemia), the term “infection with the human immunodeficiency virus (HIV)” means the presence of laboratory evidence for human immunodeficiency virus infection. For the purposes of §§ 1.460 through 1.499 of this part, the term includes the testing of an individual for the presence of the virus or antibodies to the virus and information related to such testing (including tests with negative results).”
