Information Disclosure Statement [IDS] Law and Legal Definition
Information disclosure statement (IDS) is a list of all patents, publications, U.S. applications, or other information submitted for consideration by the United States Patent and Trademark Office (PTO). This is submitted in a non-provisional patent application filed under the statutory provisions in order to comply with applicant's duty to submit to the PTO information which is substantial to patentability of the invention claimed in the non-provisional application.
For patent applications filed under 35 USCS § 111(a), applicants and other individuals who are substantively involved in preparing or prosecuting a patent application should submit to the PTO information which is material to patentability. The PTO provides forms for use in the submission of IDS, the PTO/SB/08a and PTO/SB/08b.
