Inscrutable Fault Law and Legal Definition
The term inscrutable fault signifies a judicial finding that a fault has occurred but the court is unable to locate the source, or to clearly identify a tort-feasor due to conflict of testimony or absence of corroborating evidence. The term is used in maritime law with regard to the tort liability resulting from collision of vessels. In such cases, both the parties are not entitled to recovery.
