Interference With Burial Law and Legal Definition
Interference with burial is a tort consisting in interfering with the right to the solace of burying the body of one's spouse or kin, whether by mutilation of the body after death, disturbing it otherwise, withholding it, or preventing entrance to the cemetery. It includes unconstitutional interference with private rights in refusal, on the part of a public officer, to permit one to bury the body of his/her friend or relative except under unreasonable restrictions.
