Interstate Pollution Abatement Law and Legal Definition
According to 42 USCS § 7426, in order to abate interstate pollution, a written notice is provided to all nearby states in the U.S. Each applicable implementation plan must:
1. Require each major proposed new source to provide written notice to all nearby states the air pollution levels of which may be affected by such source prior to the commencement of construction is to be permitted by the state
2. Identify all major existing stationary sources and provide notice to all nearby states of the identity of such sources.
Any state or political subdivision can petition to find whether any major source or group of stationary sources emits prohibited air pollutant. On receipt of such a petition, the authorized administrator can either find a solution or deny such petition after public hearing.
