Investigative or Litigating Function Law and Legal Definition
According to 10 CFR 2.4 (Title 10 – Energy, Chapter I; Nuclear Regulatory Commission; Part 2 - Rules of Practice for Domestic Licensing Proceedings and Issuance of Orders), Investigative or litigating function means --
(1) “Personal participation in planning, conducting, or supervising an investigation; or
(2) Personal participation in planning, developing, or presenting, or in supervising the planning, development or presentation of testimony, argument, or strategy in a proceeding.”
