Judgment of Non Suit Law and Legal Definition
Judgment of nonsuit refers to the judgment that is given against a plaintiff who fails to be present in court. Judgment is rendered against the plaintiff who fails to be present in court to hear the jury render its verdict or who, after issue is joined, fails to bring the issue to be tried in due time. However, this judgment does not prevent the plaintiff from filing the same case again.
In Stockwell v. Inter-Island Steam Navigation Co., 22 Haw. 206, 207 (Haw. 1914), it was held that the judgment of nonsuit is granted on the merits of said former action.
