Kelsey S. Father Law and Legal Definition
Kelsey S. father refers to a right whereby an unwed father is entitled to recognition of his real parental relationship absent a showing of unfitness on promptly demonstrating a full commitment to his parental responsibilities. The right is named after the case, Adoption of Kelsey S., 1 Cal. 4th 816 (Cal. 1992) wherein the standard was set. The rule is not of much significance now as most family law statutes, now recognize fully the rights of a father whether a child is born within or outside of wedlock.
