Necessary Property (Eminent Domain) Law and Legal Definition
Necessary property means property to be used for a public use. It is a property which the public entity is authorized to acquire by eminent domain. Eminent domain statutes expressly provide that any public entity authorized to exercise the power of eminent domain may acquire property which is necessary for a particular use.
