Privileges are introduced in law by necessity. Privileges are ensured by the statute to necessitate easy administration. Necessity induces a privilege for the protection of a private right. A court will grant this privilege even to a trespasser when the risk of harm to an individual or society is apparently and reasonably greater than the harm to the property.
