Nemo Potest Nisi Quod De Jure Potest Law and Legal Definition
A person can do only things, which s/he can do lawfully. Under law, a thing which cannot be lawfully performed is considered not within one's power. A presumption arises that all what a person does is lawful and within his/her power to do lawfully. In other words, in the absence of a contract to the contrary, a person is presumed to do no illegal acts. When law entitles a right to a person, the right cannot be defeated by a separate deed. However, there is an exception to this rule. A father can dispose of his entire property, by way of gift to persons other than his children, defeating children’s claim to their father’s property.
