New Matter Law and Legal Definition
“As a term of art in United States patent law, "new matter" is defined as subject matter not included in the original specification, claims, or drawings of a filed patent application. 35 U.S.C. § 132(a) provides that no amendment shall introduce new matter into the disclosure, and the basis for evaluation of whether an amendment contains new matter is the written description requirement in paragraph 1 of section 112.” InteliFUSE, Inc. v.
