Non Probate Property Law and Legal Definition
A non probate property is that part of an estate which is not distributed by a deceased’s will if the deceased has a will; or that part of the estate not distributed under the concerned state intestacy statute. Usually the distribution of such property would have been finalized before the death of the owner. A property may be made non probate by the deceased before his/ her death, like through an inter vivo transfer; or the property may be made non probate by any applicable laws.
