Nonfeasance Law and Legal Definition
Nonfeasance means the failure to do an action that is required by law to be performed. It results in creating a liability. When an official fails to perform his official duty it results in nonfeasance.
The elements that constitute nonfeasance include:
1.their must be a duty of care owed by one person to another;
2.their must be a failure to do such duty; and
3.their must be a failure resulting from such failure.
