Noninsured Crop Disaster Assistance Program [NAP] Law and Legal Definition
The Noninsured Crop Disaster Assistance Program (NAP) is a federal government initiative that provides financial assistance to producers of noninsurable crops, when any low yield, loss of inventory, or prevented planting occurs due to natural disasters. It provides assistance to those eligible crops that are categorized as noninsurable crops. It also provides eligible producers of eligible crops coverage equivalent to the catastrophic risk protection level of crop insurance. The NAP is designed to help reduce production risks faced by producers of commercial crops or other agricultural commodities. It reduces all those financial losses that occur when natural disasters cause a catastrophic loss of production or where producers are prevented from planting an eligible crop.
A crop is deemed to be a noninsurable crop when the catastrophic risk protection level of crop insurance is not available, and is any of the following commercially produced crops:
1.Crops that are grown for food;
2.Crops that are planted and grown for livestock consumption ;
3.Crops that are grown for fiber, such as cotton and flax;
4.Crops that are grown under a controlled environment such as mushrooms and floriculture.
According to 7 CFR 1437.9, not all eligible causes of loss will apply to all crops and commodities. There are certain ineligible causes that the NAP does not recognize for the purpose of granting benefit. The causes include :
1.Negligence or malfeasance of the producer;
2.Failure of the producer to reseed to the same crop during the same planting period in those areas and under such circumstances where it is customary;
3. Failure of the producer to follow good farming practices.****
