Notice of Allowance and Fees Due [Patent] Law and Legal Definition
With regard to patents, ‘notice of allowance and fees due’ is a notification to the patent applicant, to inform him/her that s/he is entitled to a patent under the law. The notice also requests the applicant to pay the specified issue fee within three months from the mailing date of the notice of allowance. The time period for the fee payment cannot be extended. If possible, the applicant should also remit the publication fee, on receiving the notice. If an application is subject to publication under 37 CFR 1.211, the notice of allowance will require both the issue fee and the publication fee.
