Notice of Patent Right Law and Legal Definition
Notice of patent right is a notice given by a patentee or his assignee, when he makes or sells the article patented. It is given either to the whole public by marking the article patented or to an infringer by informing him of the patent and of his infringement of it. The marking and false marking statutes exist to give the public notice of patent rights. [Gonzales v. Trimedica Int'l, Inc., 2010 U.S. Dist. LEXIS 132056 (E.D. Cal. Nov. 30, 2010)].
