Notice of References Cited [Patent] Law and Legal Definition
In the context of patents,'Notice of References Cited' means a list of relevant references that are cited by a patent examiner in an office action. Office action is a document prepared by a patent examiner after examining the patent application. Examples of references are: domestic patents, domestic patent application publications, foreign patents/patent publications, publications, electronic documents, and affidavits. A notice of references cited is also known as PTO-892 form.
References that have been cited by the examiner during the prosecution, including those appearing in Board of Patent Appeals and Interferences decisions, or listed in the reissue oath, must be listed on either a form PTO-892, or on an Information Disclosure Statement (PTO/SB/08 **) and initialed. These reference citations will be printed in the patent.
