Nunquam Indebitatus Law and Legal Definition
Nunquam indebitatus means never indebted. It is the name given to a plea in an action of indebitatus assumpsit whereby the defendant denies that he was ever indebted to the plaintiff.
Nunquam indebitatus is a traverse, a negative plea, not indeed as comprehensive as non assumpsit for payment or a release can not be given in evidence under it, but nevertheless it is a denial of a plaintiff's cause of action. [Pittsburg v. Walter, 69 Pa. 365 (Pa. 1871)].
