Nuper Obiitt Law and Legal Definition
Nuper obiitt means s/he recently died. It is the name of an ancestral writ to establish an equal division of land, where, on the death of the ancestor, who had several heirs, one entered and held the others out of possession. In English law, it lies for a sister co-heiress, dispossessed by her coparcener of lands and tenements, whereof their father, brother, or any common ancestor died seized of an estate in fee simple.
