Oath Against an Oath Law and Legal Definition
Oath against an oath is a dispute in which the testimony of two witnesses is contradictory, and the fact finder has to choose the words of one witness to decide the case. An oath against an oath is also known as swearing match or a swearing contest. Generally, the word of the more reputable person is chosen. For example, if the testimony of a police officer and a prisoner are contradictory, the fact-finder may opt to choose the testimony of the police officer.
