Open Court, as the name suggests is a court that is open to the public. The public is free to attend an open court session. The Constitution of some states has open court provisions and guarantees public’s right to attend trials.
Open court also refers to a court that is in session, attended by the parties, their attorneys and presided over by a judge. An open court is engaged in judicial business. Formal entries are made on the record in case of an open court.
