Original Filing Basis Law and Legal Definition
Original filing basis is the basis set forth in the application as initially filed. Pursuant to the U.S. Trademark Act, there are five filing base, out of which an applicant specifies and meets the requirements of one or more bases before the mark will be approved for publication for opposition or registration on the Supplemental Register. The original filing base is the filing base that an applicant specifies in the application originally.
