Rate of Levy Law and Legal Definition
The term rate of levy includes those rates the taxing authorities shall be authorized to levy without a vote and also those rates which have been or may be authorized by elections for additional or special purposes. [Southwestern Bell Tel. Co. v. Hogg, 569 S.W.2d 195 (Mo. 1978)].
There are three factors in taxation: (1) assessed valuation; (2) amount of money necessary to be raised; and, (3) rate of levy. The rate of levy is always the last factor to be determined, and to be obtained as a quotient, the assessed valuation being the divisor and the amount of taxes the dividend.
