Recrimination Law and Legal Definition
Recrimination literally means a countercharge. It refers to the usage “you too” that is often used by the lawyers. In Family law it is a defense in an action for divorce in which the accused party makes a similar accusation. For example in an action for divorce when both parties accuse adultery there is recrimination. In many jurisdictions the defense of recrimination has been abolished.
In Criminal law recrimination refers to an accused person's counteraccusation against the accuser. The accusation may be for the same or a different offense.
