Representative of a Deceased Person Law and Legal Definition
Representative of a deceased person is the executor or administrator of a deceased person. A person or party who has succeeded to the right of a deceased person by purchase, descent, or operation of law is the representative of that deceased person. A representative of a deceased person is appointed by the law, to represent an ancestor and not by a testator in his will.
The following is an example of a case law defining representative of a deceased person:
A representative of a deceased person, sometimes called a 'personal representative,' or 'legal representative,' is one who is executor or administrator of the person described. [Davis v. Davis, 26 Cal. 23 (Cal. 1864)].
