Request to Reinstate an Application Law and Legal Definition
In the context of Patent law, request to reinstate an application is the request filed to reinstate a patent application. If an application is abandoned due to a United States Patent and Trademark Office (PTO) error, an applicant shall file a request to reinstate the application, instead of a petition to revive. There is no fee for a request for reinstatement. A request for reinstatement should be filed within two months of the issue date of the notice of abandonment. One has to include a true copy of the document that was timely submitted, and a copy of an acceptable form of proof of receipt in the PTO.
