Retroactive Application Law and Legal Definition
Retroactive application of law takes away or impairs vested rights acquired under existing laws, and creates new obligations or imposes new duties on individuals. A retroactive law attaches a new and different legal effect to past transactions or considerations. Hence, retroactive criminal laws that increase punishment for acts committed prior to their enactments are considered as unconstitutional.
