Temporary Emergency Access [Energy] Law and Legal Definition
According to 10 CFR 62.2 [Title 10 – Energy; Chapter I -- Nuclear Regulatory Commission; Part 62 -- Criteria and Procedures for Emergency Access to Non-Federal and Regional Low-Level Waste Disposal Facilities; Subpart A -- General Provisions], the term temporary emergency access means “access that is granted at NRC's (Nuclear Regulatory Commission) discretion under § 62.23 of this part upon determining that access is necessary to eliminate an immediate and serious threat to the public health and safety or the common defense and security. Such access expires 45 days after the granting and cannot be extended.”
