Terminal Disclaimer [Patent] Law and Legal Definition
In the context of Patent law, terminal disclaimer is a statement filed by a patent owner under 35 USCS § 253 and 37 CFR § 1.321(b) or (c). This is abbreviated to “TD.” Terminal disclaimer is filed to disclaim or dedicate to the public the entire term or any portion of the term of a patent or patent to be granted. A terminal disclaimer shall be filed for the purpose of overcoming a judicially created double patenting rejection.
