Title by Prescription Law and Legal Definition
A title by prescription is a title that may be acquired by use and time. The elements of such a title are open, visible, and continuous use under a claim of right, adverse to, and with the knowledge of the owner. While a title by prescription does not rest upon statutes of limitation, the courts incline to consider a prescriptive period as analogous to the time fixed by the law of the state as to limitations for commencing actions for the recovery of real property.
